The new regime in the Court system – 1 September 2021

Going to court is not something people usually want to do, rather they are compelled. Courts exist because people are in conflict with judges making decisions for people when they cannot come to agreement.

Courts are sometimes criticized for not delivering outcomes for those who seek justice or for justice being unobtainable or far too expensive.

From 1 September 2021 new court rules come into effect seeking to deliver better outcomes.  Compliance with court orders and directives will be enforced and penalties may apply for non-compliance.

Today, more than ever before, those seeking to access the courts need to comply with the rules to avoid penalties and costs orders. This is where Chevell Legal can assist with legal representation tailored to suit your needs.

A word of warning on legal costs

Your legal costs can be driven not necessarily by you, but your adversary. Getting your documents right from the very beginning can help to limit your exposure to costs through errors. Poorly drafted documents can contain inadvertent admissions or include unnecessary and irrelevant details that can harm your case. It never makes a good impression to have to file more and more documents to correct the errors in earlier documents.

Limit your exposure to costs orders made against you in the new Federal Circuit and Family Court Act regime.

As the Federal Circuit Court and the Family Court of Australia are merging on 1 September 2021 our site will be updated shortly to detail the new arrangements.
